Mistrial Is Declared in Tax Withholding Case

Jurors in Fort Worth failed to reach a verdict Tuesday in the trial of a Texas businessman who has not withheld taxes from his workers' paychecks since 2000, the second significant setback in four months for the federal government in tax cases.

FORT WORTH - Bedford businessman Richard Simkanin remained in federal custody Tuesday night after jurors said they could not reach a verdict on a 27-count indictment accusing him of failing to withhold taxes from his employees' wages and of filing fraudulent claims for tax refunds.

Simkanin Prosecution Ends in Mistrial

After almost 6 months of incarceration in isolation awaiting his federal trial, non-withholding employer Dick Simkanin's trial ended this evening in a mistrial after the jury was unable to reach a verdict on federal charges that Simkanin failed to Withhold taxes from his employees.

Simkanin Trial Over

Fort Worth, Texas Monday, November 24, 2003 6:50 PM CST

USA v. Richard M. Simkanin now rests in the hands, heads, and hearts of 9 men, 3 women and 1 God. Today at 9:00 AM the case against Mr. Simkanin began. He was charged with 12 counts of willful failure to pay the employer's share, and withhold and pay the employees' share of the FICA and Medicare employment tax. It was stated that this was a violation of 26 USC 3402. In addition, he was charged with 15 counts of filing false claims for refund, allegedly a violation of 18 USC 287 and 292. US Attorney Jarvis presented testimony from seven witnesses. The accused, Dick Simkanin was the only witness presented by defense attorney, Arch McColl. Mr. Simkanin pled Not Guilty to all counts.

About 25 people were in attendance in the gallery for the entire day. We The People Congress was in attendance and represented by Vicki Ariatti - Colorado SC, Hank Goltz - Texas SC, Jimmy Turner - Ellis CC, Tom Selgas - Dallas CC, Melvin Floyd, Robert Cobb and other family, friends and neighbors of Mr. Simkanin and employees of Arrow Custom Plastics of Bedford, Texas.

The jury will began its deliberations at 8:30 AM Tuesday morning; We The People will be there to report the verdict as soon as it arrives.

An interesting side note occurred at the very beginning before the jury voir dire when the judge asked who was involved in passing out FIJA brochures in front of the courthouse before the trial. It appears that the majority of the first panel of about 40 jurors was dismissed because they saw the brochure or were influenced by it to some extent. A second panel was called in order to obtain 13 "untainted" souls. But, even then, 3 or 4 impaneled jurors admitted to the judge that they had a copy of the brochure. When the judge asked that they turn it in to a marshal, only one man could find it! We all will continue to wonder who passed out those blasphemous scripts inciting citizens to enforce the law. Won't we?
